Beta Terms of Use
1.Agreement to these Terms
These Terms govern your use of the Aikra application and services during the beta period. By creating an account or using Aikra, you agree to these Terms and to our Privacy Policy, which describes what we collect and what we refuse to collect. If someone invites you to their circle, tapping to join is how you accept these Terms — like the person who invited you, you are then subject to them, including the disclaimers and limits below. If we change these Terms in a way that matters, we will tell you in the app before the change takes effect, and continuing to use Aikra after that date means you accept the change.
2.What Aikra is, and what it is not
Aikra does two things. It keeps a calm, honest read on conditions around the area you ask it to watch, using published public information. And it carries small signals of care between you and the people you choose: a check-in that says you are okay, and a help signal that quietly asks them to come.
Aikra is not an emergency service. It is not 911, it does not contact emergency services or any responder, and no one at Aikra monitors, reviews, or responds to any check-in, help signal, alert, or report. In an emergency, contact emergency services directly if you are able. Do not rely on Aikra as your only means of obtaining help.
Aikra provides situational awareness and guidance, not professional advice, and not a safety guarantee. Conditions can change faster than any data source. The absence of an Aikra alert does not mean that a location or situation is safe. Your judgment always comes first.
3.Who may use Aikra
The beta is available to people 18 and older. At signup we ask your date of birth to determine eligibility. We use it for that decision and do not keep it: after screening, our records reflect only that you attested to being 18 or older, and when. Aikra relies on your self-declaration and does not independently verify age. If we obtain actual knowledge that an account holder is under 13, we will suspend and remove the account as described in our Privacy Policy.
4.Your account
Your account is created with your phone number, verified by a one-time code, and a display name. Keep your information accurate and your device secure; what happens through your signed-in account is treated as done by you, so tell us promptly at legal@aikra.com if you believe your account has been used without your permission. One account per person.
5.Circles, check-ins, and the help signal
Your circle. Your circle is the set of people you choose and add yourself. Aikra never adds anyone to your circle and never discloses your circle to anyone outside it.
What a check-in does. Tapping check-in sends your current state (that you are okay) to the members of your circle. Your circle sees your current state and your check-ins. Your circle never sees your location, your movements, or a history of your states, because Aikra does not collect or keep those things.
What the help signal does, and everything it does. Pressing and holding sends a help notification to the members of your circle. That is the entire function. The help signal does not contact 911, emergency services, dispatchers, or any responder, and Aikra does not monitor or respond to it.
What we can and cannot see about delivery. Aikra can determine that a check-in or help signal has been transmitted (it left our systems addressed to your circle) and, where a circle member uses the Aikra app, that it has been seen (that member opened it). Aikra cannot always determine whether a notification was delivered to a particular phone, and never guarantees that it was. The product shows you only the states we can actually determine.
No guarantee of delivery. Transmission and delivery depend on mobile networks, devices, carriers, and third-party delivery services outside our control. Signals can be delayed or can fail. Do not rely on Aikra as your only way of reaching help or of telling the people you love that you are okay.
Circle members are people who care, not responders. Accepting a circle invitation means someone wants you to be able to reach them. It does not make anyone a monitor, guardian, or emergency responder, and it does not create any duty to watch for, respond to, or act on any check-in or help signal. Whether and how to respond is always each circle member's own choice.
6.Circle invitations
You invite people to your circle by giving a name label and sending the invitation from your own phone; you do not enter anyone's phone number into Aikra, and Aikra never holds a number for a person who has not joined. Declined invitations are revoked immediately; unaccepted invitations expire and are deleted after 14 days; you may cancel an invitation at any time with the same effect. If an invitee is not eligible to join, the invitation simply goes unaccepted; Aikra does not tell you why someone did not join, because their reasons are theirs.
Messaging. Aikra communicates by SMS for account verification and safety-circle notifications; these are transactional messages tied to your use of Aikra, and we send no marketing by SMS. Circle invitations are sent by you, from your own phone, not by Aikra. Message frequency varies; message and data rates may apply. Reply STOP to opt out of non-essential messages and HELP for help.
7.Conditions information and guidance
Aikra's awareness comes from publicly published governmental feeds, including weather, air quality, seismic, and agency-published public-safety incident information, together with structured condition reports from members (Section 8). We translate this into states, guidance, and alerts for the coarse area you ask Aikra to watch.
When Aikra cannot see enough to render a judgment, it says so: the app will show that coverage is limited, partial, or calibrating rather than pretending to a confidence it does not have. Public sources can be delayed, incomplete, or wrong, and our translation of them can be too. We do not warrant the accuracy, completeness, or timeliness of any conditions information, and you should treat it as one input to your own judgment, never a substitute for official instructions from authorities.
8.Community condition reports
Members can report conditions through a fixed set of condition types (for example fire or smoke, flooding, or a downed line). Reporting is structured on purpose: there is no free-text field, no photo or media upload, and no way to describe or identify a person, and reports are shown without the reporter's identity and expire on schedules suited to each condition type.
Report only what you reasonably believe to be true. Do not submit false reports, use reports to harass or target anyone, or attempt to identify a reporter or any person from a report. You give Aikra a nonexclusive, royalty-free license to use, display, aggregate, and delete condition reports as part of operating the service. We may remove any report and may restrict reporting by accounts that misuse it.
Community condition reports are created by members, not by Aikra. Aikra circulates these reports among members; it does not generate, author, verify, or endorse them, and it is not responsible for their accuracy, completeness, or timeliness. Reports are one input to your own judgment, never a substitute for official information or instructions from authorities. Reports do not notify emergency services. For emergencies, call 911.
9.Your location
Precise location stays on your device. Aikra's service receives only the coarse area you ask it to watch, keeps no location history, and renders no maps of people. Where a feature uses your device's location capabilities, the computation that involves your precise position happens on the device. The Privacy Policy describes this architecture in full.
10.Acceptable use
Do not misuse the help signal or check-ins, including sending false help signals other than in genuine error; do not use Aikra to monitor, harass, stalk, or control another person; do not interfere with or attempt to probe, overload, or disrupt the service; do not attempt to access another person's account or data; do not reverse engineer the service except where law permits despite this term; do not use Aikra for any unlawful purpose; and do not access the service by automated means. We may suspend or terminate accounts for violations, with judgment proportionate to the conduct.
11.The First Light program
The first 500 accounts activated in each launch metro receive the First Light designation: a numbered, in-app recognition of the earliest people to trust the product, intended as lasting recognition, subject to these Terms. First Lights may receive early access to select features, at our discretion and on the same as-is basis as the rest of the beta, and invitations to share input on product direction. The designation is an honor and a voice, not an instrument: it has no monetary value; conveys no equity, ownership, revenue share, or other financial interest; is not compensation; grants no governance or decision rights; and is personal and non-transferable. First Light status is visible only to you unless you separately opt in to public recognition, and you can withdraw that consent at any time.
12.Feedback
If you give us feedback, suggestions, or ideas about Aikra, we may use them freely, without restriction, attribution, or compensation, and you assign to Aikra any rights needed for us to do so. We invite feedback genuinely; this clause exists so that using it never requires a negotiation.
13.Aikra's property and your license
The Aikra service, application, design, text, marks, and underlying systems belong to The Aikra Company. We grant you a personal, nonexclusive, nontransferable, revocable license to use the app and service under these Terms during the beta. No other rights are granted.
14.Beta status
Aikra is in beta. Features may change, appear, or be withdrawn; availability may be interrupted; markets may be added or paused; and data sources may come and go, which the coverage display will reflect honestly. We may update the app and these Terms as the beta evolves, with notice as Section 1 describes.
15.Leaving, and our termination rights
Leaving is yours, and it is quiet. You may stop using Aikra, leave any circle, reduce what you share, or delete your account at any time, in the app, without exit steps designed to slow you down. Deletion removes your identity information and current states promptly, retains only aggregate information that does not identify you, and notifies no one: your circle is not told that you left or why, and nothing in the product announces your departure. The Privacy Policy describes deletion in detail.
Our termination rights. We may suspend or terminate an account that violates these Terms, or where the law requires. Removal for a violation ends the license in Section 13; Sections 2, 5 (the no-duty provision), 12, 13, and 16 through 19 survive any termination.
16.Disclaimers
Aikra is provided as is and as available, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Without limiting Section 2: we do not warrant that the service will be uninterrupted, timely, secure, or error-free; that any signal will be transmitted, delivered, or seen; or that any conditions information, guidance, alert, or report is accurate, complete, or current. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
17.Limitation of liability
To the fullest extent permitted by law, The Aikra Company and its officers, directors, and personnel will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for loss of data or goodwill, arising from or relating to the service, and our total liability for all claims relating to the service will not exceed the greater of one hundred dollars and the amounts you paid Aikra in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited by law, including where applicable liability for gross negligence, willful misconduct, or personal injury caused by our negligence to the extent a jurisdiction prohibits its limitation.
18.Your responsibility for your use
You agree to indemnify Aikra against third-party claims, and associated reasonable costs and fees, to the extent arising from your violation of these Terms or your misuse of the service. This obligation does not apply to claims arising from Aikra's own conduct.
19.Disputes and governing law
These Terms are governed by the laws of the State of Washington, without regard to conflicts rules. Before filing any claim, you agree to contact us at legal@aikra.com and give us thirty days to work in good faith toward resolution. Claims that qualify may be brought in small claims court. Any other dispute will be resolved in the state or federal courts located in King County, Washington, and both parties consent to their jurisdiction and venue. Any claim must be brought within one year of when it accrued, where law permits this limit.
20.General
These Terms and the Privacy Policy are the entire agreement between you and Aikra about the beta service, and they replace prior discussions. If part of these Terms is found unenforceable, the rest continues in effect. You may not assign these Terms; we may assign them in connection with a reorganization, financing, or sale, and any assignee remains bound by them, including the commitments in Sections 5, 9, and 15. Our not enforcing a provision is not a waiver. Notices to you will be given in the app or to your account contact information; notices to us go to legal@aikra.com or the address above.
